Terms & Conditions
These Terms explain the basis on which Tremor Audio provides its online store and handles customer orders.
About these Terms
These Terms & Conditions govern your use of the Tremor Audio website and purchases made through it. By using the website or submitting an order, you agree to these Terms.
Online store use
Tremor Audio is an online store operating in New Zealand. You must use the website lawfully and must not interfere with its operation or security.
Product information
We take reasonable care with product descriptions, images, specifications and other information. Details can change, and screen settings may affect how colours appear. Please contact us before ordering if a particular feature is essential to your decision.
Pricing
Prices are shown in New Zealand dollars. If an obvious pricing error is identified, we may correct it and contact you before accepting or proceeding with the affected order.
Orders and acceptance
Submitting an order is an offer to purchase. We may decline or cancel an order where reasonably necessary, including where a product is unavailable, an obvious pricing or listing error has occurred, payment fails, or fraud is suspected.
Product availability
Product availability can change. An item appearing available on the website does not guarantee that it can be supplied until the order is accepted.
Payment
Payment is handled through Shopify's hosted checkout using the options made available there. The selected payment provider's terms may also apply.
Finance and payment providers
Afterpay and Gem Visa may be available for eligible purchases. Provider terms, fees and eligibility requirements apply. See our Finance page for current information.
Delivery
Delivery areas, charges and estimated timeframes are set out on our Delivery page. Delivery timeframes are estimates rather than guarantees.
Price Match
Our current Price Match eligibility, exclusions and request process are set out on the Price Match Guarantee page.
Returns and faulty goods
We do not accept returns solely because a customer has changed their mind. This does not affect rights relating to faulty goods or any other rights that cannot lawfully be excluded.
See our Returns & Faulty Products page for the current contact-first process.
Consumer Guarantees Act
Nothing in these Terms excludes, restricts or modifies rights that cannot lawfully be excluded under the Consumer Guarantees Act 1993 or other applicable New Zealand law.
Where goods or services are supplied and acquired in trade, the parties may agree in writing that the Consumer Guarantees Act does not apply, but only where the statutory requirements for doing so are satisfied.
Product warranties
Products may be covered by an applicable manufacturer warranty where one is available. Your statutory rights under New Zealand law also continue to apply. Contact us or follow the process on our Returns & Faulty Products page if a product may be faulty.
Website content and intellectual property
Website content, including text, images and branding, is owned by or licensed to Tremor Audio or the relevant rights holder. It may not be copied or reused without permission except where the law allows.
Third-party services
The website uses or links to third-party services, including Shopify, Vercel, Algolia, Judge.me and payment providers. Those providers may apply their own terms and policies to the services they operate.
Customer account responsibilities
Customer accounts are hosted by Shopify. You are responsible for keeping your account access secure and for providing accurate information.
Errors and omissions
We may correct errors, inaccuracies or omissions on the website. Where an error affects an order, we may contact you and may decline or cancel the affected order where reasonably necessary.
Liability
Nothing in these Terms limits rights or remedies that cannot lawfully be excluded. To the extent permitted by law, Tremor Audio is not responsible for indirect or consequential loss. Nothing excludes liability for fraud, deliberate misconduct, or any other liability that cannot lawfully be excluded.
Changes to these Terms
We may update these Terms from time to time. The current version will be posted on this page.
Governing law
These Terms are governed by the laws of New Zealand.
